Terms of Service

These terms govern use of this website and our services. Specific project scope, deliverables, and price are confirmed in writing during engagement. Where we and a client sign a separate project agreement, that agreement controls to the extent it conflicts with these terms.

  • Workflows we build are handed to you for review, testing, and approval before you enable them against real customers, real data, or a production system.
  • You are responsible for reviewing and approving each automated workflow — including any customer-facing message, integration, or data action — before it goes live, and for confirming it fits your business.
  • You are responsible for the accuracy of the data, credentials, and access you provide, and for your own compliance with any laws that apply to how you use the delivered workflows (for example, marketing, messaging, and data-protection laws that apply to your business and its customers).

We may provide a delivery target for a scoped workflow, but timing depends on scope, access, testing, client decisions, and third‑party approvals. Any delivery target is a limited delivery commitment, not a guarantee of business results. Any delivery remedy, refund, or credit must be stated in the applicable written project agreement. We do not guarantee specific business results, including revenue, lead volume, conversion rates, time saved, or cost savings from any workflow, system, or service we build. Results depend on factors outside our control, including your existing systems, data quality, third‑party platforms, and how the delivered workflows are used after handoff.

Any ongoing service, minimum term, renewal, recurring charge, and cancellation method must be stated in the applicable written agreement before purchase. Ongoing plans currently have a three‑month minimum. The website does not authorize a charge or change the terms of a signed agreement. If an automatic-renewal offer is made, the final offer and acknowledgment will state the applicable recurring terms and how to cancel.

Our services connect with and depend on third‑party platforms (for example, scheduling, messaging, CRM, and payment tools) that we do not own or control. We make no warranty about the availability, security, pricing, or continued operation of any third‑party platform, and we are not liable for outages, policy changes, or data loss caused by a third‑party platform.

Except for any express commitment stated in a signed project agreement or on the Services page, our services and deliverables are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, Waypoint Automation Consulting LLC's total liability arising out of or relating to our services will not exceed the amount you paid us for the specific engagement giving rise to the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised such damages were possible.

You agree to indemnify and hold Waypoint Automation Consulting LLC harmless from third‑party claims arising out of your use of the delivered workflows, content or data you provide, or your failure to review and approve an automated workflow before enabling it — except to the extent the claim arises from our gross negligence or willful misconduct.

SMS / Text Messaging Terms

When you consent to receive SMS messages from Waypoint Automation Consulting, the following terms apply: Message frequency varies (typically 1-4 messages per request or engagement). Message and data rates may apply. Reply STOP to opt out of future messages at any time. Reply HELP for support. Consent to receive SMS is not a condition of any purchase or service. We do not share SMS opt-in data with third parties for marketing. We retain minimum suppression and consent records as required to honor opt-outs and meet legal obligations.
